We reviewed the Law on Natural Monopolies and regulations for the Natural Monopolies Regulator and the Register of Kazakh Natural Monopolies. We made an assessment to provide information on institutional powers and responsibilities of antimonopoly authorities in respect to the regulation of national monopolies versus regulation of other sectors of the economy. The purpose of our mission was to improve the Republic of Kazakhstan’s rating in the World Economic Forum (WEF) in terms of the global competitiveness index; especially in the indicators of effectiveness of anti-monopoly policy, intensity of local competition, and extent of market dominance.
At the end of the Project, our firm developed a report on unfair competition practices and aligned recommendations with the respective Kazakh Competition Act of January 1st, 2009 to enhance legislation and reinforce powers. The recommendation included in the report were in line with the best international practices on the regulation of natural monopolies and proposed changes to align the laws of the Republic of Kazakhstan on Competition and Natural Monopolies and Regulated Markets. The report eliminated inconsistencies and clarified institutional responsibilities.
