Assessment of Collateral Registry and credit bureaus legislation (Peru)

 

The Inter-American Development Bank commissioned Econlex Corp. to undertake a study of the legal underpinnings of access to finance in Peru with the end objective of developing a plan to improve national access to finance.

The Inter-American Development Bank commissioned Econlex Corp. to undertake a study of the legal underpinnings of the Peruvian access to finance situation, with the end objective of developing a plan to improve the national accessibility of capital.

In our final project presentation, we developed a report that analyzed the recent domestic economic trends of non-banking intermediaries as well as bank lending to SMEs. We also carefully revised the many recent reforms to the secure lending framework and found many flaws within judicial enforcement and the collateral registry system, as well as the Law 28,677 (dealing with secured transactions). The report we presented made specific recommendations for reform and its timing, as well as the detriment caused by the limited use of courts and the bankruptcy system on the part of SMEs.
