Competition institutional strengthening (El Salvador)

Econlex was appointed to develop a plan of action for the design and organization of a Superintendence of Competition that would oversee the effective enforcement and execution of Competition Law in El Salvador. We developed an extensive research scheme in conjunction with various public administration institutions and ministries in order to flesh out the aspects that would be linked to the operations of the “Superintendence of Competition”, the needs of the competition sector and the goals of such an institution. As part of the task we also reviewed Salvadorian legislation in the matters of Competition Law, procedural legislation and the Law of Societies in order to develop an adequate proposal for the creation of the “Superintendence of Competition”.

By the end of the mission, we formulated instructional procedures for the presentation of suits and for the request for authorization of economic concentrations. We also created a data base for acquiring bibliographic material on matters of competition and competition law. We also produced a manual of mechanisms of coordination between the Superintendence of Competition and other regulating organisms; guidelines for the legal and economic analysis of anti-competitive practices; a strategic plan for the training of the Superintendence’s personnel; a strategic plan for the advocacy of competition which included a program for the distribution and disclosure of competition law and; a study of quality policy for the Superintendence of Competition with the final objective of ensuring the quality of the procedures.
